Welcome to MakerSpace! By becoming a member of MakerSpace, you are joining a community of entrepreneurs, creatives and work-from-home professionals. To ensure that our shared workspace is productive, respectful, and conducive to everyone’s success, we ask that you carefully read and agree to the following Terms and Conditions. These guidelines have been designed to protect both you and the MakerSpace community.
1. Limited Rights to Use of Space
Membership Privilege: Your membership grants you a license to use the designated areas of MakerSpace, but does not constitute a lease or sublease of the space.
Revocation of Membership: MakerSpace reserves the right to revoke your membership at its sole discretion. If your membership is revoked, you will not be refunded any paid membership fees, and you must immediately vacate the premises, return all access fobs, and surrender any MakerSpace property.
Changes to Space and Services: MakerSpace retains the right to modify, alter, or discontinue services, amenities, and facilities without prior notice. Any such changes will be communicated to you as promptly as possible.
Disruptions to Access: You acknowledge that at times, you may experience temporary disruptions in access due to events, maintenance, or other factors not under MakerSpace's control. These may include interruptions in internet access, conference room availability, or equipment functionality. In such cases, MakerSpace will make reasonable efforts to minimize inconvenience.
2. Cobot: The MakerSpace Membership Portal
Membership Management: Your membership is managed through the Cobot membership portal, where you will manage your profile, billing, and reservations for MakerSpace resources. The portal can be accessed at MakerSpace Membership Portal.
Payment Information: To facilitate monthly payments, each member is required to provide and maintain valid payment details in Cobot. Failure to do so may result in restricted access to MakerSpace facilities.
Changes to Membership: Membership modification requests are to be made in writing (email is sufficient), including requests to upgrade or downgrade membership plans. Requests to downgrade memberships are only considered for adjustment at the end of the current member agreement. Changes in membership are subject to approval by MakerSpace management.
3. Fees and Payment Terms
Membership Fees: Membership fees are due on the 1st of each month, and must be paid in advance. Fees are non-refundable once paid.
Late Payments: Payments made more than five days after the due date will incur a 10% late fee. If your account remains overdue for more than 10 days, your access to The Space will be suspended until payment is made reflective in a lock-out. An additional 10% fee will apply for each month that payments remain overdue.
Prorated Fees: If you join MakerSpace after the first day of the month, your membership fee will be prorated.
Membership Incentives and Transfers: Any incentives (e.g., conference room hours) provided under your membership plan expire at the end of each calendar month and cannot be carried over to the following month. Incentives cannot be transferred or shared with other members.
4. Membership Cancellation Policy
Dedicated Desk Memberships: Members with a Dedicated Desk membership must provide at least one full month’s notice of cancellation. A security deposit equal to one month’s membership fee is required at the time of signing and will be forfeited if membership is terminated before the agreed term.
Multi-Month Memberships: If you are under a multi-month membership and wish to cancel early, you are responsible for paying the remaining balance due on the membership term immediately upon cancellation.
Early Termination of Membership: In the event that you decide to terminate your membership before the end of your committed term, all remaining fees for the term will immediately become due and must be paid in full upon cancellation.
Notice of Cancellation: To cancel your membership, you must submit written notice to MakerSpace at least 7 days prior to your desired cancellation date for month-to-month memberships, and 60 days in advance for multi-month memberships (where cancellation will not take place prior to the end of the contracted agreement date).
5. Respect for Community Interests
Shared Space Use: Membership at MakerSpace Offices does not grant exclusive access to any part of the facility, except for designated private offices, if applicable. Common areas and equipment are shared among members.
Conduct Expectations: Members agree to treat the space, other members, and MakerSpace staff with respect. Disruptive, disrespectful, or harassing behavior will not be tolerated and may result in immediate membership termination.
Cleanliness: Members are responsible for cleaning up after themselves and their guests. MakerSpace management may charge a cleaning fee if spaces are left untidy, or returned to original configurations. Failure to clean up after ones self may result in membership revocation.
Employee and Contractor Information: Any employees, contractors, or team members you have working at MakerSpace must be approved by MakerSpace management, and are subject to additional investment due to MakerSpace. These individuals must submit contact information, proof of business insurance (if applicable), and a copy of their driver’s license for MakerSpace records.
Posting and Advertising: Any signs, promotional materials, or events you wish to host within MakerSpace must be pre-approved by management. Unauthorized signage or events will incur fees and will be charged at the normal hourly rate for use of the space.
Energy Conservation: MakerSpace encourages all members to help conserve energy by turning off lights, equipment, and closing doors when not in use.
6. No Illegal or Objectionable Activity
Prohibited Activities: You agree not to engage in any illegal activities in or around the building, including but not limited to drug use, illegal online activity, or activities that may damage or impair the functioning of The Space. Engaging in such activities will result in immediate membership termination without refund.
Business Conduct: You agree not to engage in any morally objectionable activities or business practices that could harm MakerSpace's reputation or the reputation of its members. This includes, but is not limited to, using The Space for illegal downloading, identity theft, pyramid schemes, spamming, or distributing obscene material.
MakerSpace’s Discretion: MakerSpace reserves the right to determine, at its sole discretion, whether any activity or conduct violates the principles outlined in these Terms and Conditions.
7. Indemnification and Limited Liability
Liability for Damages: You are responsible for any damages or injuries caused by your actions or negligence. If your insurance does not cover such costs, you agree to personally cover the expenses.
Limitation of Liability: MakerSpace, its agents, employees, members, and contractors are not liable for any direct, incidental, special, punitive, or consequential damages arising from your participation in or use of The Space, whether the damages are caused by negligence, accident, or any other reason.
Personal Property: MakerSpace is not liable for any loss, theft, or damage to personal property stored or left unattended in any part of The Space, including private offices, common areas, or lockers.
8. Guest and Noise Policies
Guest Sign-In: All guests must sign in and out of The Space via the iPad kiosk or manually at the front desk as applicable. You are responsible for ensuring your guests comply with all MakerSpace policies.
Noise Control: You are responsible for controlling the noise level in your area of use and ensuring that your guests do the same. Excessive noise that disrupts other members will not be tolerated.
9. Final Provisions
Policy Updates: MakerSpace reserves the right to update these Terms and Conditions at any time. Members will be notified of any changes within 14 days of enactment. However, it is your responsibility to periodically check the Terms and Conditions for updates.
Governing Law: These Terms and Conditions shall be governed by Maryland law. Any disputes arising from your membership will be settled in accordance with the laws of Maryland.
Invalid Provisions: If any portion of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full effect.
By signing up for a membership at MakerSpace, you acknowledge and consent to these Terms and Conditions, and agree to abide by them for the duration of your membership.
